The Atlantic City Public School District is requesting bids and/or proposals for the following goods and/or services:

Sealed bids/proposals will be received and opened at the following location:

1300 Atlantic Avenue, 5th Floor

Atlantic City, NJ  08401

The bid and/or RFP opening process will begin on the advertised date and at the advertised time and location.  The Atlantic City Board of Education does not accept electronic (e-mail) or faxed proposals or bids.  No proposal or bid shall be received after the time designated in the advertisement (N.J.S.A. 18A:18A-21(b)). 

Blank forms of bids, specifications and general information may be obtained by submitting a request to abyngs@acboe.org .  All proposals are to be sent through the US Postal Service or other recognized delivery service that provides certification of delivery to the sender. Bids will not be accepted via facsimile transmission or email.  

Competitive contracting proposals and bids solicited pursuant to N.J.S.A. 18A:18A 4.5, N.J.A.C. 5:34-2.1, or N.J.S.A. 18A:18A-21, will be publicly opened and read immediately thereafter on the dates and times advertised. 

Prospective respondents/bidders are hereby advised not to accept specifications from anyone other than the district's purchasing administrator.

Prospective respondents and bidders are advised that the contract for the services requested in the RFP and/or bid specifications may be funded in part or entirely by the federal government and the successful respondent or bidder and Board of Education are required to comply with all sections of the Federal Uniform Administrative Requirements 2CFR part 200 et. seq. 

Pursuant to P.L. 2009, c.315 and N.J.S.A. 52:32-44, all business organizations that do business with a local contracting agency are required to be registered with the State and provide proof of their Registration with the New Jersey Department of Treasury, Division of Revenue before the contracting agency may enter into a contract with the business.

The Atlantic City Board of Education will not assume responsibility for proposals and bids forwarded through the mail or if lost in transit at any time before the RFP or bid opening.  Prospective vendors are advised to read the entire RFP or bid specifications package for special instructions.

The Atlantic City Board of Education reserves the right to reject  proposals or bids pursuant N.J.S.A. 18A:18A-22 as amended.  During the performance of this contract, the contractors are required to comply with the requirements of N.J.S.A. 10:5-31et. seq., PL 1975, C. 127 and N.J.A.C. 17:27, P.L. 2004, NJ Business Registration Act and Chapter 33, Laws of 1977. 

All respondents and bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et. seq., PL 1975, Chapter 127, Affirmative Action Against Discrimination (N.J.A.C. 17:27 et. seq.).  Corporate respondents and bidders are required by law (Chapter 33, Laws of 1977) to submit a list of names and addresses of all stockholders owning 10% or more of their stock.

A Non-Collusion Affidavit also must be filed with the proposal or bid.  The RFP and/or bid package will  include other documents that must be completed and returned with the proposal or bid.  Failure to complete and submit all required forms shall be cause for disqualification and rejection of the proposal or bid.

A Prevailing Wages Certification also must be filed with all bids for public works projects subject to the provisions of the "New Jersey Prevailing Wages Act" P.L.1963, c.150 (C.34:11-56.25 et seq).  Every contractor and subcontractor performing services in connection with a public works project shall pay all workers a wage rate not less than the published prevailing wage rates for the locality the work is being performed as designated by the New Jersey Department of Labor and Workforce Development.

No proposals or bids may be withdrawn for a period of 60 days after the date set for opening.  Right is reserved to waive minor irregularities.
